Tinubu Cannot Send INEC Boss On Terminal Leave, Says Falana

HUMAN rights activist and lawyer, Femi Falana (SAN), has stated that President Bola Tinubu does not have the constitutional power to send the National Chairman of the Independent National Electoral Commission, Prof. Mahmood Yakubu, on terminal leave.
Falana, in a statement on Friday, September 26, in reaction to a viral report that Tinubu had ordered the INEC chief to proceed on compulsory leave and to suspend official duties ahead of the expiration of his tenure, stressed that constitutional provisions had made it impossible for Tinubu to lawfully order Yakubu on terminal leave.
He stated that unlike other federal executive bodies, INEC’s powers to make its own rules or otherwise regulate its own procedure are not subject to the approval or control of the President, and to extent, the President cannot direct the INEC chairman to proceed on terminal leave.
